DUKE ROAD ZONE CHANGE: YOUR VOICE MATTERS

WHAT YOU NEED TO KNOW
The owners of a 60 bed property at 319 Duke Road are seeking a Conditional Use Permit (CUP) on Monday, March 9th at 1:30pm from LFUCG to change the primary use of the facility from a Personal Care Facility* to a Rehabilitation Home** - meaning a 60 bed in-patient residence for persons recovering from the effects of drug or alcohol abuse, psychiatric disorders, or as a condition of parole or probation. 

THIS IS THE WRONG LOCATION FOR THIS TYPE OF FACILITY. 

WHAT YOU CAN DO

1. SHOW UP! 
Attend the public hearing on Monday, March 9th at 1:30pm to oppose this Zone Change. You don't have to speak, but your presence will matter. 
LOCATION: Council Chambers, 200 E. Main Street, 2nd Floor, Lexington, KY
  • NOTE: Planning staff has currently recommended approval of this Zone Change (see the staff report). A strong turn out from the neighboring community who believe this is not the right location for this facility speaks volumes to members of the Fayette County Board of Adjustment. 

2. SEND A MESSAGE OPPOSING THE ZONE CHANGE
Send a personalized email to [email protected] OR visit www.chevychasecitizens.com to send a message to the Fayette County Board of Adjustment opposing the zone change. It takes less than 60 seconds. Every message counts. Send BEFORE Monday, March 9th. Your message needs to be on the record before the hearing.

Share this information with other concerned citizens in our neighborhood and urge them to attend the meeting and send a message opposing the Zone Change on March 9th. 
RECENT HISTORY OF THE PROPERTY
The property is presently under contract by the current owner to be sold to Roaring Brook Recovery. Roaring Brook has circulated a fact sheet that we believe misleads neighbors regarding the intended use of the property. 

2018 - The facility, originally opened as a Nursing Home, filed for a Zone Change to become an Assisted Living Facility. 
  • LFUCG defines a Nursing Home as a facility for which four (4) or more persons may be admitted for periods exceeding twenty-four (24) hours to receive treatment and/or medication for bodily illness, including convalescence from illness.
  • LFUCG defines an Assisted Living Facility as a residential facility, other than a nursing home, with multiple and separate living units, meal preparation, laundry services, room cleaning, transportation, and/or recreation may also be provided, as well as some medical services, exclusively for the residents of the facility.​
2023 - The facility filed for a Zone Change to become a Personal Care Facility. 
  • *LFUCG defines a Personal Care Facility as a long-term facility with resident beds, devoted primarily to the care of aged or invalid persons who do not require the level of intensive care normally provided in a hospital or nursing home; but who do require care in excess of room, board and laundry.
​2026 - The facility now seeks a Zone Change to become a Rehabilitation Home.
​If this Zone Change is approved, all uses included in the scope below are permitted for future services at this location, even if not the specified use(s) at this time, and DO NOT require a future zone change application. 
  • **LFUCG defines a Rehabilitation Home as a building or group of buildings providing a supervised residence for persons recovering from the effects of drug or alcohol abuse, psychiatric disorders, or as a condition of their parole or probation. Such homes may provide counseling in educational, vocational, or other areas by a paid or volunteer staff and generally have 24-hour-a-day supervision. This definition does not apply to uses regulated by KRS 100.982.
